Question:

Can your name go on a cavet on a house if you have already claimed bankruptcy without the property being affected. My name is not title but cavet maybe if i can. can you do your will while on bankruptcy and still not being discharged till sept?

Answer:

Pam, There are no restriction on the preparation of a will whilst in bankruptcy. If you had an interest in a house at the date of bankruptcy, your interest would be an asset which the Trustee is required to realize on and should be disclosed to the Trustee. If you have acquired an interest in a house after the date of bankruptcy, that should also be disclosed to the Trustee as that interest must also be dealt with by the Trustee. Thanks for the question.
