If I claim bankruptcy in Alberta, do I have to leave my home? What are the rules in regards to owning your home when you claim bankruptcy?

Answer:

 

Jeannie No you do not have to leave your home. Firstly of course you need to keep your mortgage payments up to date. You will need to have the market value of your home determined by way of either a realtor evaluation or an appraisal. If the equity in your home is less than $40,000, it is exempt. If the equity exceeds $40,000 you will have to make arrangements with the Trustee to pay the amount over $40,000 into the bankruptcy through refinancing or payments over time.
