Kathy, There is no requirement that you sell your house when you file for bankruptcy. The Trustee will need to determine what if any equity there is in your residence. A market evaluation from a realtor is a starting point. There is an exemption of $40,000,if you have little or no equity the Trustee will not have an interest.
