Question:

A Company I used to work for filed for bankruptcy and I was supposed to bring the company to small claims court for unpaid overtimes. I have heard that they are protected under Bankruptcy and that the moment they filed for bankruptcy that are not obligated to pay for unpaid overtimes

Answer:

Certain employment related claims have a preferred status in bankruptcy and you should contact the Trustee to discuss your claim. Certain claims are also protected under the Wage Earner Protection Program Act ("WEPPA"),again you should contact the Trustee acting in the bankruptcy of your former employer to discuss your claim. Thanks for the question.
