If a person is in bankruptcy already, can they switch bankruptcy companies if they have not been discharged yet, and secondly, what date is your bankruptcy effective? example - if you file June 23 but you had extra money does that count as surplus income for June or is it anything after your file date? thanks.

Answer:

 

Sami, You cannot switch your Bankruptcy Trustee after your assignment without the approval of the Creditors at a Creditors Meeting. The effective date of your bankruptcy is the date the Official Receiver issues the Certificate of Appointment which is usually the date you sign the bankruptcy documents. The timing of receipt of funds and it's inclusion in surplus calculations should br discussed with your Trustee. Thanks for the question. Marie Kozlowski
