Question:

Just a question - my ex wife has declared bankruptcy in April of 2012 and has not paid any surplus amounts even though she should (500-600 per month). She says she is no longer in bankruptcy and that the bank will be coming after her for the money she owes. Can you clarify if this is correct or if she is still in bankruptcy and will not be discharged until she has made 21 consecutive payments of her surplus income to her trustee. Thanks

Answer:

Bruce It appears from your question that perhaps your ex spouse's discharge has been adjourned to some point in the future and that the Trustee has closed the file and furthermore that her creditors are free to take collection action against her again. I cannot clarify her status without having her full name et. I suggest you call her Trustee and ask the question, you can also search the status of her file by contacting the Office of the Superintendent of Bankruptcy's website at Industry Canada. Regards and thanks for the question.
