my husband and I got scammed on a timeshare in mexico and it looks like bankruptcy is the only way out we both are on the contract. I own a house in my name only my mother left me, and own property in joint tenancy with my children how would this be affected, and would we both have to claim bankruptcy to get out of this timeshare we have never used it bought last feb

Hello I am sorry to hear of your experiences with the Mexico timeshare. Unfortunatelt, your home could be affected by a bankruptcy depending upon how much equity is available in the home and whether you live in the residence, however there is a personal residence exemption of $40,000 available. Any equity that is attributable to you in the property held with your children may be payable to a Trustee in any bankruptcy you file.
