Question:

if you declare bankruptcy, and 6 months later you are awarded a nelp award from wcb, does that monies go back to the trustee?a nelp award is given to someone who has had a permanent disability through work, it is usually awarded 2 years after the last surgery was performed.

Answer:

Brian A NELP award is largely for pain and suffering and is likely exempt from the bankruptcy proceeding. An application to the Court may need to be be made to receive advice and direction as to the exempt ststus of the award. Thanks for the question.
