Question:

CRA registered a lien against my home, jointly owned with on again off again common law wife, also file a judgement on equifax and garnisheed my bank account for 150k. I am self employed, how am I to operate? I have made 15 calls over the last 90 days trying to make arrangements and have not received a single call back from the name on all the CRA documents. Now the wife ?? Wants to sell and run, we have a 3 year old child that deserves healthy home life, but wife is constantly upset over money issues. (She doesn't work). Equity is about 45 - 50 k, as she is on title but never contributed can CRA seize her share? How likely is it to renew with scotiabank while in a three year bankruptcy? Can the lien be lifted?

Answer:

Dealing with CRA in these circumstances is never easy especially when CRA is in enforcement mode. I understand your concerns and yes, it is a stressful and scary scenario and your partners concerns are understandable. Your spouses interest in the residence is likely safe from CRA, however the bank is unlikely to renew the mortgage with the writ on title. You need to resolve this situation as soon as possible, you can contact me at your convenience and I will be happy to review this in more detail with you. Thanks for the question.
