I have a mortgage with a bank it was originally Wells Fargo and now it is with National, my original principal was for 38500 and now is 39500 after 8yrs, I also have a loan for 20k that is worth more than the original loan amount borrowed. both have a lien on my home, if declare bankruptcy can they still garnishee my wages for debt repayment? I do not want to leave my job but the 21 and the 16% interest rate they are charging I will never pay the debt off and they will not renegotiate.

Answer:

 

The mortgage holder will be be able to commence foreclosure proceedings if you fail to maintain the mortgage payments. If the loan was set up as a secured loan when you obtained it, the holder of the loan will be able to coomence the equivalent of foreclosure proceedings if you fail to make the required payments. However if this loan is secured by a writ obtained after judgment, bankruptcy may eliminate this loan.
