Question:

I went bankrupt August 20, 2012 and have been released from bankruptcy. I am now getting a collection agency calling me for a debt that I believed my ex husband had taken care of, He did not. Since I did not claim this debt at the time of bankruptcy do I now have to pay it? Thank you for clearing this up for me.

Answer:

Cindy Firstly, you should request confirmation from the collection agency that you are legally liable. Your bankruptcy discharges all debts that you are liable for including those debts which you honestly omitted to include. You should contact your Trustee and ask for the appropraite documentation concerning your bankruptcy to be sent to the creditor and the collection agency. You do not have to pay this debt.
