If you owe a court ordered spousal support monthly payment, does that payment come off your income before you calculate your surplus income? Gross or net income? If you filed bankruptcy on march 31, 2014, how long till you would be on file at the OSB.

Answer:

 

Spousal support paynments are a non discretionary expense which is deducted from your income before calculating surplus income. Please note that the payments have actually got to be made and evidence of payment provided. You disclose net income in calculating surplus income. Your file is maintained indefinitely by the OSB.
