Dainna If you continue to make your mortgage payments, there is no reason that you would lose your home when in bankruptcy. There is an exemption of $40,000 of equity which you are entitled to retain, if you have equity above this amount you will be required to pay that amount to the Trustee, either by way of refinancing or over time.
