Hi does your wife have claim bankruptcy with you if her name is on the accounts. Last question can they take your house.

Answer:

 

Hi If your wife is a co borrower on your credit card accounts and if you file for bankruptcy or simply fail to make the required payments, the credit card creditors can take collection action against her. You must maintain your mortgage payments, failing to do so would result in foreclosure action. If your unsecured creditors obtain judgment, they can file a writ against title to your home but cannot force a sale if your equity is less than $40,000. You are entitled to retain this amount as an Exemption from enforcement action.
