Question:

 

I have a judgement against me for about $11,000. They have filed an "Intent to Sell Land" via a title on my home. (The title is joint with my wife). My question is does Bankruptcy stop this action? I have 3 children aged 9 and cannot have my house sold from under me. (Even if just 50% is sold). Please advise.

Answer:

 

Hi If you are referring to a judgment debt held by an unsecured creditor and if have more than $40,000 of equity in your home, the creditor can seek a sale of the land. You should contact legal counsel to represent you or at the very least represent yourself at any Court application. If this is an unsecured creditor with Judgment filing a Consumer Proposal or a Bankruptcy assignment would legally prevent this enforcement action.
