Hi, I had an incorporated company, which I kept afloat with the line of credit that was on my house. I have a business consolidation loan and company visa line of credit. The company has failed and I can no longer make the payments. My estranged husband has paid me all my equity from the house. Can I claim business bankruptcy? What are my options? Thank you

Answer:

 

Hi Melisha Bankruptcy of your corporation will not deal with any debt relating to the company if you are personally liable/ jointly liable or have guaranteed the corporate debt. A bankruptcy for your corporation would only be feasible if there were assets in the corporation to liquidate and distribute to creditors.
