Bankruptcy Calgary Edmonton Q&A Forum

Question:

If I go for a consumer proposal, I would like to continue paying off my car loan which is finished in September 2015 is that exempt and the other part is I am living with my son, but will be moving out into my own place in October 2015, how can the living cost be determined or do they only base this on now

Answer:

Hi Trish, The budget projected for filing a consumer proposal is usually reflective of the monthly expenses for the up coming months. If there is no rent payable right because you have a vehicle payment but you have secured a place to live in October 2015 then the Trustee may communicate that with your creditors for the purpose of filing the proposal. That will allow the creditors to understand where the extra cash is flowing to. Please do not hesitate to contact our office if you would like to discuss.
