Hello, I'm curious what happens when the person who held a file stopped contacting during a bankruptcy case and payments were no longer taken? I have check the superintendent of bankruptcy and the individual is not discharged however. Can the payments simply be restarted or does the process have to begin again?

Hi Mel, When an individual files for bankruptcy, there is a stay of proceedings, which stops the creditors from collecting the debt. No payments should be made to the debts included in bankruptcy such as unsecured loans and credit cards. I would suggest contacting the Trustee on file to obtain an update why the bankrupt is not discharged. The bankrupt may not be eligible for a discharge for many reasons.
