Bankruptcy Calgary Edmonton Q&A Forum

Question:

Hello, I'm curious what happens when the person who held a file stopped contacting during a bankruptcy case and payments were no longer taken? I have check the superintendent of bankruptcy and the individual is not discharged however. Can the payments simply be restarted or does the process have to begin again?

Answer:

Hi Mel, When an individual files for bankruptcy, there is a stay of proceedings, which stops the creditors from collecting the debt. No payments should be made to the debts included in bankruptcy such as unsecured loans and credit cards. I would suggest contacting the Trustee on file to obtain an update why the bankrupt is not discharged. The bankrupt may not be eligible for a discharge for many reasons. Hope that answers your questions. If you have any other concerns please contact our office.
