Edmonton, Calgary bankruptcy Q&A forum

Question:

I am currently unemployed and have accumulated credit card and lines of credit debt of aprox $180K. I am currently 57 years old and am drowning in the ability to pay this down. My common law spouse has sole name on the title of our residence and also is sole name on the mortgage. If I have to file for bankruptcy, is she safe from creditors? Her name is not on ANY of my debt. Thank You

Answer:

Hello, Based on the facts provided, I would say that your common-law spouse's credit rating will not be affected if you filed for bankruptcy as you do not share any credit. Please do not hesitate to contact our office should you have any other questions or concerns.
