Bankruptcy Calgary Q&A forum

Question:

I am 70 years old. My only income is OAS and CPP. I am partners with my husband in a small business which makes no money. I owe about 70k. My concern is I have a truck loan which my husband has paid since day one as he had good income but bad credit. The truck is 80% paid for. The truck is registered to me. Can my husband pay it off so I can transfer it to his name 4 0r 5 months before I file for bankruptcy? I don't want him to lose the truck. Equity in the truck is about 15k. Thank you.

Answer:

Hi Audrey, All assets transferred to a family member or sold on the eve on bankruptcy will be reviewed by the Trustee. However, we do look at the equity available. Perhaps you would like to contact office to discuss the bankruptcy process and exempts applicable to you and your spouse. We can be reached at 310-8888 should you have any questions.
