Question:

 

I have a friend who is currently working out of the country and needs to file for bankruptcy in Alberta. Will he be able to file from where he is working (Cayman Islands)? What will happen to the money that he is earning now? He is still a Canadian Citizen and planning to return to Canada but maybe not for a year or so. Can anyone touch his money in the Cayman Islands? Will he have to return to Alberta to file bankruptcy?

Hello, If the creditors are not pursuing him then he maybe able to wait until he returns to Canada before filing for bankruptcy. We would be happy to have a discussion with you or your friend to discuss the bankruptcy and other formal options. The creditors will only freeze his bank account or garnish his wages if there is a judgment granted or if the bank has the right of offset.
