Hi, A previous tenant has declared bankruptcy. Is my RTDRS judgement against him still valid? It is his first Bankruptcy, so if I wait 9 months and serve his employer, will I still get my money via garnishee?

Answer:

 

Hello Rob, There is a stay of proceedings which prevent the enforcement of the RTDRS judgment. Once the bankrupt is discharged after the 9 months then the debts that he owes are no longer collectible, except, you may recover a small amount from the bankruptcy estate if the previous tenant had assets or surplus income payable to the bankruptcy.
