My son is having his house repossessed. He has CMHC mortgage. He is worried that they can come after his car, his last asset. Two questions, 1. can they seize his car? 2. his wife left him, her name not on mortgage, but she should still be liable for half owing? She'd want half if it had gone up in value, unfortunately, this is Alberta, 2018, so it's way down.

Hi Greg, In Alberta, a judgement creditor such as CMHC, cannot seize a vehicle if the equity available is less than $5,000.00. CMHC will only obtain a judgement or enforce collection from the mortgage applicants. Your son will need to seek a legal opinion on her responsibility if it was the matrimonial property.
