Question:

 

Hi I have a few questions, My ex walked away from our jointly owned home and I'm having trouble keeping up with all the Bills and our mortgage which has negative value at this point. If I declare bankruptcy and include my house depreciation as a debt and it hasn't gone into foreclosure (everything is current but I'm drowning in debt.) can the bank still come after me for the mortgage in the future? How will it effect my ex who wants nothing to do with the house but it is still in his name? Will our divorce and seperation agreement stating that I would eventually get the house in my name (I couldn't because he left me in too much debt) effect my bankruptcy and will it still allow the bank to go after him?

Answer:

 

Hello, The depreciation or shortfall of the mortgage from your house can be included in a bankruptcy or proposal. Once the bankruptcy or proposal is all done you will not be responsible for the debt. If the mortgage is jointly held with your ex then he will also be responsible for the shortfall even if you file for bankruptcy.
